Who Is Eligible For PSEBA?

First responders who are eligible for PSEBA include:

  • Law enforcement officers
  • Firefighters
  • Correctional officers
  • Probation officers

To be eligible for PSEBA benefits, a qualifying person must have suffered a catastrophic first responder injury while working and their injury was incurred while responding to an emergency, or while in response to fresh pursuit, or while investigating a criminal act, or as a result of an unlawful act perpetrated by another. Job injuries that happen that do not fit under one of these scenarios are not PSEBA-eligible, and typical workers’ compensation or disability claim steps should be followed instead. Furthermore, the family members of qualifying first responders are eligible for certain benefits if their loved one who qualified for PSEBA passes away from injuries suffered under one of these scenarios.

What Is A Catastrophic Injury?

PSEBA cases can be complicated for many reasons, including the fact that the Act does not include a specific definition of a “catastrophic” injury. However, Illinois courts have defined a “catastrophic injury” as being any injury that precludes the injured first responder from continuing to work in their chosen profession. Injured first responders can run into a wall of trouble in their case if any other involved party tries to argue that the injuries in question are not technically “catastrophic.”
