Subcontractor or Contractor Negligence
Chicago Contractor Negligence Lawyers
Injured construction workers who seek our legal counsel and representation have sometimes been injured because of negligence of contractors or subcontractors at construction sites where they work. An injury brings pain and expenses no matter who or what caused an accident. However, legally and financially, case outcomes may differ quite a bit, depending on the chain of command under which on-the-job injuries occur.
At a construction site, a contractor is generally hired by the property owner to accomplish a building objective. It is the contractor’s responsibility to ensure that safe practices are followed. He or she should follow OSHA guidelines and require other people at the construction site to do the same. He or she is responsible for making sure that scaffolding is erected safely; that trenches are safely excavated; that loose materials are not left strewn on walkways and that people working on high places are properly protected with safety straps.
If you were working directly for a contractor when you were injured, you most likely have a workers’ compensation claim, regardless of whether the contractor was at fault. If the property owner was negligent, you may have a third-party liability claim against him or her.
A subcontractor works for a contractor at a construction site, usually in some specialty area such as electricity, plumbing, framing carpentry, bricklaying, masonry or finish carpentry. If you were injured at the construction site where you were working because of negligence of a subcontractor, you may have the opportunity to file an injury claim or lawsuit against that person.
