Anesi Ozmon attorneys secured a significant verdict of $1.2 million on behalf of their client, a Local 74 Bricklayer who suffered an open fracture to the tibia bone in his leg. On the date of the injury, the Plaintiff was standing on a scaffold 16 feet above the ground, where he was constructing a brick wall.  During his shift, the weather in the surrounding area began to worsen and strong winds began to develop. Without an official order to leave the site, our client and his colleagues continued to work on the scaffold. As the weather conditions became progressively worse, the site’s supervisors failed to order a timely evacuation. Very rapidly, the storm reached the worksite location and toppled over the brick wall, causing the scaffolding to collapse while the Plaintiff was still standing on the structure.

As a result of the fall, the Plaintiff suffered an open fracture to the tibia bone in his leg. This type of fracture is a severe injury as it causes the broken bone to rupture through the skin. Our client underwent surgery to place a metal rod in his bone and to prevent any infection from developing at the injury site.

Before trial, the Defense offered a $50,000 settlement. The settlement offer would have only covered half of the Plaintiff’s medical bills. While other law firms are often quick to settle, our attorneys determined that the offer was unfair and rejected the settlement. The trial attorneys understood that their client should be fairly compensated for his losses and would not settle for less than the maximum compensation he is entitled to due to his serious injury.

A jury in the Circuit Court of Cook County returned the verdict in complete agreement with the total damages amount of $1,228,594 requested by attorney Steven Berman.
