Anesi Ozmon, Rodin, Novak & Kohen, Ltd. Secures $2.5 Million Settlement for Worker Whose Left Leg was Amputated by a Truck

Partner Steven A. Berman of Anesi Ozmon, Rodin, Novak & Kohen, Ltd. secured a $2.5 million settlement on behalf of a worker after his left leg was severed by a rear tire of a large tractor-trailer at a worksite.

At the time of the incident, our client was an independent contractor and business owner. His job required him to follow and escort large loads during transport. During his employment, he would at times walk alongside the load or sit on the rear fender while the load was moving. Before he was injured, he was in the process of escorting a driver and a load involving a 131-foot crane beam to its final destination. As the driver moved the truck, our client slipped from his position on the rear of the vehicle, and his leg was crushed under the weight of the rear tire causing the lower leg to be amputated.

The injury was so severe that he had to be airlifted to the hospital. The life-altering injury caused our client to suffer immense physical and psychological pain at the time of the event and throughout the recovery process. Although the physical, emotional, and monetary issues continued to burden our client, the Defense compounded the injury by arguing that he was completely responsible for his own injuries.

The Defense claimed that our client, the Plaintiff, acted unsafely and without permission. The truck driver and the individual in charge of the procedure testified that our client was completely at fault for his injuries. Our client explained that it was common practice for workers to “ride the load”.  He added that the Defense saw him on prior occasions perform the action and never once told him to stop.

Without a witness in his favor, Attorney Steven Berman dedicated his legal expertise to prove that there was a legitimate act of negligence on the part of Defendant. Although these men were the only people present when our client lost his leg and their testimony was all against our client, attorney Steven Berman was able to successfully dispute their claims and secure a significant settlement of $2.5 million for the injured worker.

The catastrophic injury our client suffered created permanent life changes and challenges. As he can no longer return to his previous employment or a normal way of life, the settlement will help to secure financial stability for him and his family as well as pay for ongoing medical care relating to his injuries.
